What Debts Are Dischargeable? Will I Lose My Property?
With a Chapter 7 bankruptcy, you may discharge most forms of consumer debt, including credit card debts, medical bills and other unsecured debts. Only a limited number of debts are not dischargeable, including certain tax debts, child support obligations and student loans. Judgments resulting from wrongful conduct like fraud may also be void from discharge for reasons of public policy.
Many people who are considering bankruptcy are concerned that they will lose all of their property. Fortunately, most people are able to save all or substantial portions of their property through bankruptcy exemptions and, if necessary, debt reaffirmation agreements for specific property items. If a Chapter 7 bankruptcy would result in the loss of considerable property, a Chapter 13 bankruptcy may be a preferred option.
Am I Eligible for Chapter 7 Bankruptcy?
In 2005, the U.S. Bankruptcy Code was amended to include a means test which is taken into account when people file for bankruptcy. Unfortunately, many people incorrectly assume that they are no longer eligible for bankruptcy relief.
There is good news. Most of the people who contact our office are eligible for Chapter 7 bankruptcy, and the majority of those who are not eligible for Chapter 7 bankruptcy are eligible for Chapter 13 bankruptcy.
